Cancellation and No-Show (Required agreement at booking)
We are committed to providing you all with exceptional service. When clients cancel without giving enough notice, they prevent another client from being seen. Please give us 24 hours’ notice to notify us of any changes or cancellations. We understand that life’s circumstances sometimes prevent you from keeping your appointments, but if 24-hour notification is not given, you will be charged a non-refundable cancellation fee equal to 50% OF YOUR BOOKED SERVICE. No-show appointments can be rescheduled with full pre-payment of the service at the time of re-booking.
Ultrasound Waiver and Communication Policy (Required agreement at booking)
Prenatal Care: I acknowledge that I have been informed by Nurture LLC that prenatal care is important to a healthy pregnancy. I am currently receiving prenatal care and my doctor has been informed and has no objections to my attending this sonography session.
Concerns Should Be Referred to Physician: I have also been informed by Nurture LLC that use of Nurture LLC services cannot substitute for care of a physician. If I have any concerns regarding my pregnancy, I will contact my doctor. I will in no way rely upon Nurture LLC or its services for medical advice.
No Professional Negligence Claims: I am purchasing Nurture LLC services and products for keepsake, non-medical purposes. I agree that I have no right to recourse against Nurture LLC in any medical malpractice, professional negligence or any medical-related claim arising out of or in any way related to my pregnancy or the birth of my child. This includes any claim for error in gender determination.
Assumption of Risks: I acknowledge that there is an inherent risk in any activity involving a fetus and there are potential risks in this type of activity. I understand Nurture LLC follows FDA recommendations for length of scan and frequency of ultrasound sound waves, and that no detrimental effects have been found in 40 years of studies. I hereby voluntarily assume all risk of harm or injury to me or my baby resulting from the services provided by Nurture LLC.
Waiver and Release of Claims: I hereby waive, release, acquit and forever discharge Nurture LLC from any and all claims, expenses, demands, costs, causes of action, and other actions and liabilities, of any nature whatsoever, whether known or unknown, whether in law or equity, that I or my baby may have arising out of or in any way related to my visit to Nurture LLC. I agree that I shall have no right whatsoever to file any lawsuit or institute any other action or legal proceedings of any type arising out of or in any way related to my visit to Nurture LLC.
Photo Release: I give Nurture LLC permission to post or use any photos or recorded data for advertisement purposes. I understand no names will be posted or used with the photos.
Picture Quality: I understand picture quality is dependent on many factors. I understand that Nurture LLC is not always able to obtain pictures of every baby. I understand no refunds are available if unable to obtain pictures or gender.
I agree to allow Nurture will communicate with me via email, voice and text regarding my appointments and future Nurture programs that they may share with me via these methods. I may unsubscribe from these messages in the future.
I have notified my physician that I have chosen to obtain an elective fetal ultrasound from Nurture LLC & I understand my physician has not ordered this. I understand that this ultrasound is not to be used to replace physician care. I have been informed that the federal Food and Drug Administration has determined that the use of medical ultrasound equipment for reasons other than medical purposes, without a physician’s prescription, is an unapproved use. I have been informed that Nurture LLC follows FDA recommendations for frequency (sound waves) and length of scan which has found no detrimental effects in 40 years of case studies.
Liability Waiver & Communications Agreement (Required agreement at booking)
I am participating in yoga classes, health programs, educational classes, workshops and/or other wellness, body work, therapy, exercise and healing arts activities (collectively, the “Activities”) offered by Nurture LLC (the “Studio”). The Activities may be offered in the physical location of the Studio or offered online by videos, television, podcasts, live stream, apps or other digital media or platforms. All of such offerings, either physical or online, shall be considered “Activities.”
I may participate in educational or training class regarding my wellness, birth, pregnancy, postpartum and or child. This information is not to serve as medical advice. Any information obtained should be discussed with your care provider to obtain consent for use.
I recognize that I must be in adequate physical and mental health to participate in the Activities. I understand that the Activities may require intense physical exertion, and I represent and warrant that I am physically fit enough to participate, and I have no medical condition which would prevent my full participation in the Activities. I recognize that the Activities may cause or aggravate a physical injury or medical condition. I understand that it is my responsibility to consult with a physician before my participation in the Activities. If I have done so, I have taken the physician’s advice. If I am pregnant, become pregnant or I am post-natal or post-surgical, my signature verifies that I have my physician's approval to participate. I understand that the Studio reserves the right to refuse my participation in any Activity on medical, fitness or any other grounds.
I am aware that my participation in the Activities could result in high blood pressure, fainting, heartbeat disorders, physical injury, heart attack or stroke and may aggravate pre-existing injuries. I understand that I could experience muscle, back, neck and other injuries as a result of my participation in the Activities. I understand my physical limitations and I am sufficiently self-aware to stop or modify my participation in any Activity before I become injured or aggravate a pre-existing injury.
In consideration of being permitted to participate in the Activities, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the Activities at the Studio, including those which may result from the negligence of the Studio.
In further consideration of being permitted to participate in the Activities, I knowingly, voluntarily and expressly waive any “Claim” (as defined below) I may have against the Studio, its owners, managers, teachers, instructors, workshop presenters, employees, independent contractors and staff (each, a “Released Party”) that I may sustain as a result of participating in the Activities at the Studio even if the Claim arises from the negligence of any Released Party or anyone else.
I agree to indemnify and hold harmless each Released Party from any loss, cost, or liability incurred in defending any Claim made by me or anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the negligence of any Released Party or anyone else.
“Claim” includes but is not limited to any and all liabilities, claims, demands, expenses, fees, legal actions, rights of actions for damages, personal injury, mental suffering and distress, or death that I may suffer, my spouse, children or unborn child may suffer (including any legal fees or expenses) in connection with participation in any Activity.
I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue any Released Party for any Claim caused by any negligence or other acts of a Released Party.
I hereby understand that the Studio from time to time may photograph, video, or otherwise record classes or events occurring at the Studio and place such photographs and videos on its Website or social media platform. I hereby consent to the use of my image that may appear in any such photograph or video.
I agree to allow Nurture will communicate with me via email, voice and text regarding my appointments and future Nurture programs that they may share with me via these methods. I may unsubscribe from these messages in the future.
This agreement shall be construed in accordance with, and governed by, the laws of the State of Ohio and that all actions, suits, claims and proceedings relating to this agreement shall be brought in a court of competent jurisdiction located in Hamilton County Ohio. In case any provision of this agreement shall be held invalid, illegal or unenforceable, it shall not affect any other provision of this agreement and this agreement shall be construed as if such provision had never been contained herein.
I acknowledge that I have carefully read this agreement and fully understand its contents. I voluntarily and knowingly agree to the terms and conditions stated herein. I am aware that by signing this agreement, I am giving up substantial rights, including my right to sue and certain legal rights my heirs, next of kin, executors, administrators and assigns may have against any Released Party.
Ultrasound Gender Determination Policy (Required agreement at booking)
We love to help our clients discover baby's gender - and we want it to be right! Ultrasound scans are not 100% accurate for gender and that is the type of risk we just don’t want to impose on our clients. Our team wants you to leave Nurture with the confidence you need to plan your gender reveal party, send announcements, and simply enjoy your own knowledge of your baby's gender. That is why we do not provide gender determination with Ultrasound but do offer SneakPeak DNA blood testing for gender confirmation with 99.99% accuracy and next day results.
Sneak Peak Lab Delivery & Holidays (Required Agreement at booking)
The sample we collect from you is sent to a lab via FedEx. Nurture will get you sample to the lab in time to meet the pick-up cut-off. FedEx does a great job getting your sample to the lab, however, sometimes due to weather or internal errors at FedEx, your sample may be delayed (this is rare). In these cases, we can provide the FedEx tracking info and help you to determine any delays that are being experienced.
The lab is closed on certain holidays. If the following holidays fall on the day your sample arrives to the lab or while you sample is at the lab being processed, your sample will be delayed by the same number of days.
For example, if your sample is taken on Saturday August 31 and you booked a Next Day result, due to the Monday Labor Day holiday, instead of receiving your result on Monday, you would receive it on Tuesday. If you booked a Two Day result, you would receive you results on Wednesday.
